Terms of Service

Service Description

Maptide is a web-based tool for creating custom map overlays and exporting them as KML files that can be imported into Google My Maps or other KML-compatible map applications. By using Maptide, you agree to these terms of service.

License & Use

We grant you a limited, non-exclusive, non-transferable license to use Maptide for creating and exporting personal or business maps. You may not: (a) reverse-engineer or decompile the service; (b) use automated tools to scrape data or bulk-download assets; (c) use Maptide for illegal purposes or to violate any third-party rights; or (d) resell or redistribute access to Maptide.

Icon Library License

Maptide provides a curated library of pre-designed icons ("Library Icons") for use in your maps.

Permitted Use

You may use Library Icons solely within KML files exported from Maptide and in the resulting Google My Maps documents into which those KML files are imported. This license extends to your personal or internal business use of the maps you create.

Prohibited Use

You may not:

• Extract, download, or copy the Library Icons (SVG, PNG, or other formats) for use outside of a Maptide-generated KML export
• Redistribute, republish, or share the Library Icons as a standalone asset collection, library, or icon pack
• Modify, reverse-engineer, or create derivative works of the Library Icons, except for standard resizing, recoloring, or repositioning performed through Maptide's own editor interface as part of normal map creation
• Use the Library Icons in competing products, design systems, or as a substitute for licensed icon libraries
• Sublicense or grant others permission to use the Library Icons independently

Your Custom Icons

Any custom icons or designs you upload to Maptide remain your intellectual property. You warrant that any custom assets you upload do not infringe third-party rights. You agree that your custom icons are subject to the same export and use restrictions as Library Icons — they may only be shared within exported KML files and maps.

Enforcement

Violation of this icon license constitutes a material breach of these terms of service. Maptide reserves the right to suspend or restrict your access to the service, including the icon library, and pursue legal remedies for unauthorized use. We employ technical measures (including watermarking, usage logging, and rate-limiting) to enforce these restrictions, and you acknowledge that these measures are authorized by this agreement.

Copyright Notice

Library Icons are copyrighted works of Maptide. Extraction or redistribution of Library Icons outside a Maptide-generated KML export may also constitute copyright infringement, independent of any breach of these Terms of Service.

Your Map Content

You own the map data you create in Maptide (shapes, text, annotations, and layout). When you export a KML file, you have the right to share, modify, and republish that KML as you see fit, provided it complies with these terms and Google My Maps' terms of service.

Intellectual Property

Maptide, including the editor software, user interface, icon library, and all related content, is owned by Maptide. These materials are protected by copyright and other intellectual property laws. You agree not to reproduce, modify, or use any Maptide intellectual property except as explicitly permitted by this agreement.

Disclaimer of Warranties

Maptide is provided "as is" without warranty of any kind, express or implied. We do not warrant that the service is error-free, uninterrupted, or suitable for your purpose. We are not responsible for data loss, export failures, or changes to Google Maps or KML specifications.

Limitation of Liability

To the maximum extent permitted by law, Maptide is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service or content, except for damages arising from our gross negligence, willful misconduct, or where prohibited by law. Our total liability for any claim is limited to the greater of $100 or the amount you have paid us in the 12 months preceding the claim.

Termination

Maptide may terminate or restrict your access immediately if you violate these terms, including unauthorized use of icons or the service infrastructure. You must stop using Maptide and delete any downloaded assets upon termination.

Changes to These Terms

We may update these terms from time to time. Material changes will be announced via email or a prominent notice on Maptide. Your continued use of the service after changes become effective constitutes your acceptance of the revised terms.

Google Maps Integration

Your use of Google My Maps and the Google Maps API is subject to Google's terms of service. Maptide is not affiliated with Google and does not represent Google. You are responsible for complying with Google's terms when importing and sharing KML files.

Dispute Resolution

Any disputes arising from or relating to these terms shall be resolved through final and binding arbitration administered by the International Chamber of Commerce (ICC) under its Rules of Arbitration. The seat of arbitration shall be Tel Aviv, Israel, and proceedings shall be conducted in English, unless you and Maptide agree otherwise. Each party shall bear its own attorneys' fees and costs, and shall split the ICC filing and arbitrator fees equally. Notwithstanding the foregoing, either party may seek injunctive relief for intellectual property violations in a court of law. This arbitration provision does not apply to small claims that qualify for small-claims court in your jurisdiction.

Class Action Waiver

By using Maptide, you agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative action. You may not consolidate your claims with those of others in any arbitration or legal proceeding.

Governing Law

These terms are governed by the laws of the State of Israel, without regard to its conflict of laws principles, except to the extent that local law requires a different governing law for your jurisdiction.
